3. Participation

3.1 Eligible to participate in the competition are all self-entitled persons who have reached the age of 18 and the participant must have a place of residence in Austria, Germany, Italy, Spain, or France have . Excluded are employees of the competition organizer and persons commissioned by him. Participation with fake identities or with identities of third parties is not allowed.

4. Winnings and Winning Notification

4.1 The specified prize will be drawn in camera among all participants who are eligible to participate.

4.2 Winners will be chosen from among all eligible entrants within 30 days of the entry closing date. The winners will be notified via Instagram messages and asked to send an email to an email address provided there, in which the personal data is correctly and truthfully completely transmitted. This information is used to send the prize. If the participants named in the aforementioned post do not report back within 14 days, the right to the prize will be forfeited.

A prize will be handed over by post and only after the entered data has been checked and compared. The prize will be sent by post to the specified address within 4 weeks of the name and address being announced. When the prize is sent to the participants, the risk of loss or damage passes to the participants . The participants are responsible for the accuracy of the contact details provided. The legal process is excluded. A cash payment of the prize is expressly excluded. A transfer of the prize is not possible. Austrian law applies to the present conditions of participation.

4.3 If we do not receive an e-mail from a winner with the personal data (name and address) of the winner within the specified period, the entitlement to the prize expires. In this case, we are entitled to carry out a substitute draw.

4.4 Only one prize is possible per participant.

4.5 The prize is neither transferable nor can the prize be exchanged or paid out in cash.

4.6 If circumstances arise for which we are not responsible, the respective winner accepts an appropriate replacement prize.

5. Granting of Right of Use

5.1 The participant grants the competition organizer a temporally and geographically unrestricted, transferable right to edit, use and exploit all content (texts, photos, videos, ...) created by him and posted on Facebook or Instagram for participation in the competition (in particular also for advertising purposes ) a. This includes all rights of use and exploitation known to copyright law, including related property rights and the right to assert claims arising from copyright law in court. In particular, the competition organizer is entitled to cut, change, delete, archive, store and make technical adjustments to the photos. The participant waives his right to author designation.

5.2 By accepting the prize, the winner agrees that we may use their name for advertising purposes.

6. Liability and Indemnification

6.1 If the participant uploads photos to complete the competition, the participant guarantees that he will not send any content whose provision, publication or use violates applicable law or the rights of third parties.

6.2 The participant indemnifies us from third-party claims of any kind that result from the illegality of photos used by the participant. The obligation to indemnify also includes the obligation to fully indemnify the organizer from legal defense costs (e.g. court and attorney's fees).

6.3 By participating in the competition, the participant exempts Facebook from any liability.

7. Exclusion

7.1 A breach of these conditions of participation entitles us to exclude the respective participant from participation. This applies in particular if the participant provides incorrect information or if the photos or other content (e.g. comments) used violate applicable law or the rights of third parties. The same applies to comments that can be viewed as glorifying violence, offensive, harassing or degrading or that violate social decency in any other way.

7.2 If the excluded participant is a winner who has already been drawn, the prize can be subsequently revoked.

7.3 Comments that violate Facebook and Instagram guidelines, copyright and Austrian law will be deleted immediately.

8. Early Termination and Amendments

We reserve the right to prematurely end the competition in whole or in part at any time, even without observing a deadline, or to change the course of it if it is not possible for technical (e.g. computer virus, manipulation of or errors in software/hardware) or legal reasons ( e.g. prohibition by Facebook) it is not possible to guarantee that the competition will be carried out properly.

9. Limitation of Liability

The competition organizer is not liable for damage caused by errors, delays or interruptions in data transmission, disruptions to technical systems or services, incorrect content, loss or deletion of data and viruses. After the prize has been handed over, the competition organizer assumes no liability whatsoever for damage of any kind. Any liability for damage or loss resulting from slight negligence is excluded. In addition, the competition organizer is only liable in the event of intent and gross negligence.

10. Privacy

We will only use the personal details of the participant and their other personal data within the framework of the statutory provisions of data protection law - data protection declaration . We will only save, process and use the information to the extent that this is necessary for the implementation of the competition or if the participant has given his consent. This also includes use to exercise the rights of use granted. The data will only be used to carry out the competition and will then be deleted.

11. Final Provisions

11.1 If the Conditions of Participation contain invalid provisions, the validity of the remaining conditions shall remain unaffected.
